There are a wide array of penalties that a defendant faces for distribution of CDS or personal possession at the Monmouth County Superior Court. A drug possession charge is a disorderly persons offense that is heard in municipal court under certain limited circumstances. This is the case where the CDS is 50 grams or less of marijuana, under 4 grams of hashish or less than 4 dosage units of Xanax, Valium, Percocet, Hydrocodone, Oxycodone, Suboxone or another prescription drug. While these types of drug charges are considered misdemeanors, a conviction results in up to 6 months in prison, as well as a driver’s license suspension of 6-24 months.
