In terms of manufacturing, distributing, selling or possession with intent to distribute, an offense of this nature always falls under the jurisdiction of the Superior Court in Trenton. While a distribution charge is always a felony that must be dealt with at the Trenton NJ Courthouse, the grading and severity of a violation hinges on the type and quantity of drugs being distributed. Disorderly Persons Offense for Possession of 50 Grams or Less of Marijuana, Less than 5 Grams of Hashish or 4 or Fewer Dosage Units of a Prescription Drug in Mercer County

N.J.S.A 2C:35-10a(4) makes it a disorderly persons offense to possess 50 grams of less of marijuana or 5 grams or less of hashish. The New Jersey Prescription Drug Law, N.J.S.A. 2C:35-10.5, also makes it a disorderly persons offense to be in possession of 4 or less pills or dosage units of a prescription legend drug such as Xanax, Hydrocodone, Suboxone, Vicodin, Percocet, Oxycodone or Adderall. Do not be fooled into thinking that you are in the clear if you were charged with a disorderly persons offense (as opposed to an indictable) since a conviction for a misdemeanor CDS charge in a Mercer County municipal court can land you in the county jail for as much as 6 months and also result in a suspension of your license for 6-24 months. You should also know that there is a strict bar to plea bargaining in drug cases. What this means is that you will have to successfully defend the offense if you want to avoid a criminal record, penalties and collateral consequences in one of the following Mercer County municipal courts:
